Use of the Website

You agree to use this website only for lawful purposes. You may not use the website in a way that could damage, disable, overload or impair the site, or interfere with any other user’s experience or access.

Automated access to the website, including scraping, crawling, mass downloading or use of bots without prior written permission, is prohibited.

Age Requirement

You must be at least 16 years old to create a customer account on KaiserFC.com. Persons under 18 should obtain consent from a parent or legal guardian before placing an order.

If you are accessing the website on behalf of a company or organisation, you confirm that you are authorised to bind that entity to these Terms.

Customer Accounts

Customers may create an optional account on KaiserFC.com. Guest checkout is always available as an alternative.

You are responsible for keeping your account login information secure and for all activity that occurs under your account. If you believe your account has been accessed without permission, contact us immediately at hello@kaiserfc.com.

Kaiser FC reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, abuse our customer service, or compromise the security or integrity of the website. In serious cases, we may also refuse future orders from the affected account holder.

Products

Kaiser FC currently sells made-to-order apparel, including t-shirts, hoodies, sweatshirts and related items. All products are produced individually after an order is placed.

Because each item is produced on demand, product colours, print placement, fabric texture and finish may vary slightly between units. We make every effort to display products accurately, but we cannot guarantee that your device screen will show colours exactly as they appear in real life.

Product availability, designs and pricing may change at any time without prior notice.

Orders

When you place an order, you are responsible for providing accurate information, including your name, email address, billing details, shipping address and the correct product, size and colour selections.

An order is only confirmed once you receive an order confirmation email from Kaiser FC. We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases of suspected fraud, payment issues, incorrect pricing displayed due to technical error, or violations of these Terms. If we cancel an order after payment, you will receive a full refund.

Pricing & VAT

All prices are displayed in euros (EUR) unless otherwise stated and may change at any time.

Customers within the European Union are subject to applicable VAT in accordance with German tax law. For orders shipped outside the European Union, applicable customs duties, import taxes, VAT or fees may be charged by the destination country and are the responsibility of the customer.

Shipping costs and any applicable taxes will be displayed at checkout before you confirm your purchase.

Payments

Payments are processed through secure third-party providers such as Stripe and PayPal. Kaiser FC does not store full credit card information on its servers.

By submitting payment, you confirm that you are authorised to use the chosen payment method and that the information provided is accurate.

Right of Withdrawal — Widerrufsrecht

Under European consumer law (Directive 2011/83/EU and § 312g BGB), consumers in the European Union normally have the right to withdraw from distance contracts within fourteen (14) days of receiving the goods, without giving any reason.

Exception for made-to-order products: Pursuant to Article 16(c) of Directive 2011/83/EU and § 312g Abs. 2 Nr. 1 BGB, the right of withdrawal does not apply to contracts for the supply of goods that are made to the consumer’s specifications or are clearly personalised.

All Kaiser FC apparel is produced individually after the customer’s order is placed, in the size, colour and configuration selected at checkout. These items are not held in stock and cannot be resold to another customer. Accordingly, the statutory right of withdrawal does not apply to Kaiser FC made-to-order products.

This exception does not affect your right to a replacement or refund in cases of defective, damaged or incorrectly fulfilled items. Please refer to our Refund & Returns Policy for full details.

Conformity & Warranty — Sachmängelhaftung

Statutory warranty rights for defective goods apply in accordance with German law (§§ 434 ff. BGB) and the EU Sale of Goods Directive (2019/771).

If a product you receive is defective or does not conform to the agreed specifications, you are entitled to remedy in accordance with applicable law. Please contact us at hello@kaiserfc.com within thirty (30) days of receipt with a clear description and photographs of the issue, as set out in our Refund & Returns Policy.

Cancellations

Orders may be cancelled within six (6) hours of purchase by contacting us at hello@kaiserfc.com. After this period, production may have already started and cancellation may no longer be possible.

Returns and Refunds

Because products are made to order, Kaiser FC does not accept returns or exchanges for wrong size selection, change of mind or buyer’s remorse.

Damaged, defective, misprinted or incorrectly fulfilled products may be eligible for replacement or refund if reported within thirty (30) days of delivery. Please refer to our Refund & Returns Policy for full details.

Shipping

Production and shipping times are estimates and are not guaranteed. Kaiser FC is not responsible for delays caused by carriers, customs, weather, incorrect address information or events outside our reasonable control. Please refer to our Shipping Policy for full details.

Risk of loss and title for the goods pass to the customer upon delivery to the carrier.

Newsletter & Communication

Subscription to the Kaiser FC newsletter (“The Kaiser Transmission”) is voluntary and opt-in. Newsletter delivery is processed through our email service provider, Brevo (Sendinblue SAS, France).

You may unsubscribe at any time through the link included in every newsletter, or by contacting us directly.

Intellectual Property

All content on KaiserFC.com — including text, images, designs, graphics, logos, product artwork, archive stories, photography and brand materials — belongs to Kaiser FC or is used under appropriate rights or licenses.

You may not copy, reproduce, distribute, modify, publish, sell or otherwise commercially exploit our content without prior written permission. Personal, non-commercial use (such as reading, viewing or sharing a link to a published article) is permitted.

Archive Content

Kaiser FC creates football culture content, visual stories and archive-inspired editorial material. Some archive content may be creative, interpretive, reconstructed or fictionalised for artistic and storytelling purposes.

This content is part of the Kaiser FC universe and should not be understood as official historical documentation unless explicitly stated.

Right to Refuse Service

Kaiser FC reserves the right to refuse, cancel or limit any order or restrict access to our services for any reason permitted by law, including but not limited to suspected fraud, abusive behaviour, violation of these Terms or operational constraints.

Limitation of Liability

To the maximum extent permitted by applicable law, Kaiser FC shall not be liable for indirect, incidental, consequential or punitive damages arising from the use of this website, its products or services.

Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable German or EU law.

Our website may contain links to third-party websites. Kaiser FC is not responsible for the content, policies, security or practices of external websites. Links to third-party websites are provided for convenience only and do not imply endorsement.

Force Majeure

Kaiser FC shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, acts of government, war, pandemics, labour disputes, supplier failures, internet outages, infrastructure disruption or transportation delays.

Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary or, if not possible, severed from the agreement. The remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms & Conditions, together with our Privacy Policy, Refund & Returns Policy, Shipping Policy and Impressum, constitute the entire agreement between you and Kaiser FC concerning your use of the website and the purchase of our products. They supersede all prior agreements, communications or understandings.

Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers habitually resident in another EU member state, the mandatory consumer protection provisions of that member state remain applicable.

Place of jurisdiction for all disputes arising from or in connection with these Terms is Heidelberg, Germany, to the extent permitted by applicable law.

The European Commission provides a platform for online dispute resolution (ODR), available at https://ec.europa.eu/consumers/odr. Kaiser FC is not obliged to participate in dispute resolution proceedings before a consumer arbitration board, and does not voluntarily participate in such proceedings.

We may update these Terms & Conditions from time to time to reflect changes in our practices, legal requirements or the services we offer. The latest version will always be available on this page. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.
